CONSUMER TERMS & CONDITIONS OF SALE
Britmet Coatings (a product range of Britmet Tile form Ltd)
1. Definitions
• “We”, “Us”, “Our” means Britmet Tile form Ltd.
• “Britmet Coatings” means the Britmet Tile form Ltd coatings product range.
• “You”, “Customer” means a consumer purchasing goods for personal use.
• “Goods” means products supplied under the Britmet Coatings range.
2. Application of Terms
These Terms apply to all consumer sales and do not affect your statutory rights under the Consumer Rights Act 2015.
3. Product Description & Colour Variation
3.1 Descriptions, images, samples, and colour references are for guidance only.
3.2 Colour Variation Disclaimer:
Where lighter colours are applied over darker pre-covered or previously coated surfaces, colour variation may occur. We cannot guarantee exact colour matches in these circumstances.
3.3 Minor variations in colour, finish, texture, or appearance do not constitute a defect.
4. Bespoke & Made-to-Order Products
4.1 All colours and colour-matched products are made to order.
4.2 These goods cannot be returned or refunded unless faulty or not as described, in line with the Consumer Rights Act 2015.
5. Lead Times & Delivery
5.1 Standard lead times are 5–7 working days.
5.2 Lead times are estimates only.
5.3 Risk passes on delivery.
5.4 Safe Place Deliveries:
If you request delivery to be left in a “safe place”, this is at your own risk. Refunds or replacements will not be offered for loss, theft, or damage after delivery.
6. Price & Payment
6.1 Prices are inclusive of VAT, unless stated otherwise.
6.2 Goods remain the property of Britmet Tileform until paid in full.
7. Your Legal Rights
7.1 Goods must be of satisfactory quality, fit for purpose, and as described.
7.2 If goods are faulty, you are entitled to a replacement or refund in line with statutory rights.
8. Returns & Claims
8.1 Claims must be reported within 48 hours of delivery.
8.2 Goods must not be used or altered if a fault is suspected.
9. Maintenance & Care
9.1 Ongoing maintenance is required.
9.2 Smooth Coat: Recoat every 3 years.
9.3 Texture Coat: Apply Smooth Coat after 2 years.
9.4 Failure to follow maintenance guidance may affect remedies.
10. Limitation of Liability
10.1 We are not responsible for damage caused by accidental spills, misuse, negligence, or failure to follow care guidance.
10.2 Liability is limited to the value of the goods supplied, where permitted by law.
11. Governing Law
English law applies.
TRADE (B2B) TERMS & CONDITIONS OF SALE
Britmet Coatings (a product range of Britmet Tileform)
1. Definitions
• “Customer” means any business, contractor, or trade purchaser.
• Consumer legislation does not apply to trade sales.
2. Application of Terms
These Terms apply to all trade sales and override any Customer terms unless agreed in writing.
3. Product Description & Colour Variation
3.1 All descriptions, samples, and colour references are indicative only.
3.2 Colour variation may occur, particularly when coating lighter colours over darker surfaces. This does not constitute a defect.
4. Bespoke & Made-to-Order Products
4.1 All colours and colour matches are non-returnable and non-refundable.
5. Lead Times & Delivery
5.1 Lead times are estimates only.
5.2 Risk passes upon delivery.
5.3 Safe Place Deliveries:
Goods left in a designated safe place are left entirely at the Customer’s risk. No refunds or replacements will be offered.
6. Price & Payment
6.1 Prices are inclusive of VAT, unless otherwise stated.
6.2 Payment terms are as agreed.
6.3 Title remains with Britmet Tileform until paid in full.
7. Inspection & Claims
7.1 The Customer must inspect goods immediately upon delivery.
7.2 Claims must be notified within 48 hours.
7.3 No liability is accepted for goods that have been used, altered, or mishandled.
8. Maintenance & Care
8.1 Maintenance is the responsibility of the Customer.
8.2 Smooth Coat: Recoat every 3 years.
8.3 Texture Coat: Apply Smooth Coat after 2 years.
8.4 Failure to follow maintenance guidance voids any liability.
9. Limitation of Liability
9.1 Britmet Tileform shall not be liable for:
• Accidental spills
• Incorrect application
• Misuse or negligence
• Indirect or consequential losses
9.2 Liability is limited to the invoice value of the goods supplied.
10. Governing Law
English law applies.
